Terms of Service

These Terms of Service ("Terms") govern your access to and use of the Lifted website, mobile site, and any related services (collectively, the "Service"), which is operated by Lifted Technologies LLC ("Lifted," "we," "us," or "our"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, you may not access or use the Service.

Lifted is a white-label online-ordering and compliance software platform for licensed cannabis dispensaries. The Service provides dispensaries with branded online ordering storefronts, age and identity verification, medical-card verification, purchase-limit enforcement, audit logging, and related software tooling.

Lifted is software only. Lifted does not hold a cannabis license, does not sell, distribute, or dispense cannabis or cannabis products, and does not take possession of cannabis inventory or funds from cannabis sales. All cannabis products sold through the Service are sold by independently licensed dispensaries. Payments for cannabis orders are processed by a third-party licensed cannabis payment processor, not by Lifted.

To use certain features of the Service, you must create an account and provide accurate, current, and complete information. You are responsible for maintaining the security of your account credentials and for all activity under your account. You must be at least 21 years of age (or the minimum age required by your state) to create an account. You agree to notify us promptly of any unauthorized use of your account.

You agree not to:

• Use the Service in violation of any applicable law, including cannabis regulations;
• Attempt to purchase cannabis products if you are under 21 or otherwise not legally eligible;
• Misrepresent your identity, age, or medical-card status;
• Interfere with or disrupt the Service, its servers, or its security features;
• Reverse engineer, decompile, or disassemble any part of the Service;
• Use the Service to transmit unauthorized or fraudulent orders; or
• Resell or redistribute access to the Service without authorization.

Lifted offers a free Storefront plan and paid plans. Current plans and prices are published on the Lifted pricing page and are agreed with the dispensary at signup. Lifted does not charge a setup fee. Where Lifted and a dispensary have agreed founding-partner terms, those terms govern for that dispensary.

Because cannabis cannot be processed through standard card networks, payments for cannabis orders are handled by a third-party licensed cannabis payment processor; Lifted facilitates the software connection to that processor but is not itself the payment processor and does not take custody of funds from cannabis sales. Where Lifted receives compensation from a payment processor under a partner agreement, that compensation is a share of the processing fee only, and never a share of a dispensary's product revenue.

Taxes may apply. Refund and cancellation policies for paid plans are governed by the plan terms agreed at signup; refunds for cannabis orders are handled by the dispensary that fulfilled the order.

Dispensaries using the Service are solely responsible for maintaining valid cannabis licenses, complying with all applicable state and local cannabis regulations, verifying customer identity and eligibility, fulfilling orders, and handling product quality, recalls, and customer disputes. Lifted provides compliance tooling but does not guarantee legal compliance; dispensaries remain responsible for their own regulatory compliance.

The Service is provided "as is" and "as available," without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, or non-infringement. Lifted does not warrant that the Service will be uninterrupted, error-free, or secure, or that compliance checks will catch every prohibited transaction. Cannabis remains federally illegal in the United States; use of the Service does not constitute legal advice and does not shield any party from federal enforcement.

To the maximum extent permitted by law, in no event shall Lifted be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, arising out of or related to your use of the Service, even if advised of the possibility of such damages. Lifted's total aggregate liability arising from or related to these Terms or the Service shall not exceed the amounts you have paid to Lifted in the twelve (12) months preceding the claim.

You agree to indemnify and hold harmless Lifted and its officers, employees, and affiliates from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising out of your use of the Service, your violation of these Terms, or your violation of any law or third-party right.

These Terms shall be governed by and construed in accordance with the laws of the State in which Lifted is organized, without regard to conflict-of-law principles. You agree to the exclusive jurisdiction of the courts located in that state for any dispute arising out of or relating to these Terms or the Service.

We may modify these Terms from time to time. We will post the updated Terms on this page with a revised "Last Updated" date. Your continued use of the Service after changes take effect constitutes your acceptance of the revised Terms.
